1. Acceptance of Terms

By accessing or using Drag Wall ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the Service. If you are under 18 (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Description of Service

Drag Wall is a web-based architectural planning tool that allows users to create 2D floor plans and generate construction documentation. The Service is available through free and paid licenses.

4. Availability

We do not guarantee uninterrupted or error-free operation of the Service. The Service may be temporarily unavailable for maintenance, updates, or technical reasons.

5. Account Registration

To use the Service, you must sign in through your verified Google account. You are responsible for:

Maintaining the security of your Google account and connected devices.
All activities that occur under your account session.
Notifying us immediately of any unauthorized access.

6. Payments, Refunds, and Chargebacks

Pricing and Processing: Certain features of the Service require the purchase of a license. All prices are displayed before purchase. Advertised prices may be exclusive of applicable local taxes (such as VAT or Sales Tax), which will be calculated and applied by the MOR at checkout based on your billing location. Payments are processed securely through our authorized Merchant of Record (MOR), who handles transactions and inquiries in accordance with their own terms. We reserve the right to change pricing for future purchases at any time. Price changes do not affect licenses already purchased.

Digital Content & Refund Waiver: Drag Wall provides digital software services. By purchasing and activating a license, you expressly consent to the immediate start of the service and acknowledge that you thereby lose your right of withdrawal and right to a refund. All sales of digital licenses are final and non-refundable once activated.

Chargebacks and Disputes: If you have a billing issue, you agree to contact our support team first to seek a resolution before contacting your bank or payment provider to dispute a charge. Filing a chargeback, dispute, or payment reversal without a valid legal basis or without contacting us first constitutes a material breach of these Terms. In such cases, we reserve the right to immediately suspend or terminate your account and dispute the chargeback with our payment provider by providing your account activity logs and proof of license activation.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Use automated systems to abuse or overload the Service.
Attempt to bypass licensing, authentication, or security mechanisms.
Attempt to reverse-engineer, decompile, or disassemble the Service.
Interfere with or disrupt the integrity of the Service.
Upload malicious content or attempt to gain unauthorized access.
Resell or redistribute the Service without written permission.

8. Intellectual Property

The Service, including its software, source code, user interface, graphics, trademarks, documentation, and all related intellectual property, is owned by Drag Wall and is protected by applicable copyright and intellectual property laws. You retain ownership of the content you create using the Service (floor plans, project data). By using the Service, you grant us a limited license to store and process your content solely to provide the Service.

Data Backups: While we strive to keep your data secure, Drag Wall does not guarantee the permanent retention of your floor plans or project data. You are strictly responsible for regularly exporting and backing up your projects to your local device. We shall not be liable for any loss or corruption of your data.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your personal data in accordance with applicable laws.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

It does not replace professional architectural, engineering, or construction advice. We make no guarantees regarding the structural integrity, safety, or legal compliance of any floor plans created using the Service. You are solely responsible for verifying all measurements and consulting with certified professionals before beginning any construction.

11. Limitation of Liability

To the maximum extent permitted by law, Drag Wall shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

For free, trial, or evaluation use of the Service, your access is provided entirely at your own risk, and Drag Wall shall have zero liability for any claims or damages.

For paid licenses, our total aggregate liability arising out of or related to the Service shall be strictly limited to a refund of the actual amount you paid for the specific package giving rise to the claim, and shall in no event exceed that amount.

12. Indemnification

You agree to indemnify, defend, and hold harmless Drag Wall, its creator, affiliates, and authorized Merchant of Record (MOR) from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights, including intellectual property or privacy rights related to the content you create.

13. Service Modifications

We may add, modify, or remove features as part of ongoing development.

14. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You are responsible for exporting your projects before closing your account. This includes immediate termination without notice if you initiate an unjustified chargeback or payment dispute.

15. Force Majeure

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including acts of God, war, labor disputes, internet failures, or governmental actions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.

17. Entire Agreement

These Terms constitute the entire agreement between you and Drag Wall regarding your use of the Service, superseding any prior agreements.

18. Governing Law

These Terms are governed by the laws of Georgia, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Tbilisi, Georgia.
